General conditions

Prices shown on this catalogue or website are valid with the exception of a possible typographical error or printing.

1. Applicable law

Law 21/1995 of July 6th, regulating Combined Travel, is repealed by Royal Legislative Decree 1/2007, of November 16th. These General Conditions are subject to the provisions of Royal Legislative Decree 1/2007, of November 16th, which approves the revised text of the General Law for the defense of consumers and other complementary laws, the law 7 / 1998, of April 13th, on General Conditions of Contract (14-4-98) and Law 26/1984, of July 19th, General for the Defense of Consumers and Users (BOE 24-7-84) and other current provisions.
General Conditions together with the Specific Conditions of each bike travel, always published and communicated to the consumer or user, require compliance to both contracting parties, with the particular conditions agreed in the contract or that are included in the documentation of the bike travel provided together with the subscription of the contract.

2. Organization

BICICLETOS VIAJES is a provider of tourist services in bicycle that operates under the technical organization of BROOKLYN BOY S.L. CIF B-86755477, registered in the Registro Mercantil de Madrid, in the volume: 31.285, page 60, section: 8, sheet M-563106, whose commercial name is Endeavor Travel & Sports.

3. Booking a bike travel

To make a reservation it is necessary to send an e-mail to info@bicicletos.org. Booking confirmation will be by e-mail. Reservation of any bike travel listed in this catalogue, implies full acceptance of these general conditions, considered to be automatically incorporated in the contract, with no necessary written transcription therein. This catalogue or website, indicates the duration, itinerary, price, supplements, the minimum and maximum number of participants, and services included and not included. Additional information and any modifications will be reflected in the specific information pack for each bike travel, to be delivered to the customer, which, together with the General Conditions, act as final contract.

4. Registration, payment method and refund

In the act of registration, BICICLETOS VIAJES requires as a reservation deposit the amount stipulated in the Specific Conditions of each bike travel when making the reservation, as well as fullfillment of the following marked payment terms, issuing the corresponding receipt noting the amount advanced by the client, and the bike travel requested. In the event that a person registers other(s), he/she assumes on his behalf the entire content of these General Conditions. No commitment is considered until the deposit is made. When registration is made on a date where several payment terms have already been requested, according to the Specific Conditions of each bike travel, consumer must pay as reservation the whole amount requested .
Final amount must be paid for the delivery of vouchers and / or documentation of the bike travel, and must be made at least 7 calendar days (for national routes) and 15 calendar days (for routes abroad) before the departure date of the bike travel. Failure to pay the marked terms or the total price under the conditions indicated, it will be understood that the consumer desists from the requested travel, being subject to the cancellation conditions detailed in chapter 9 of these General Conditions.
All reimbursements will always be formalized through BROOKLYN BOY S.L., not making any refund for services not used by the consumer. In the event that a person registers another, he / she assumes in his / her name each and every one of the implications specified in these General and Specific Conditions of each bike travel.
* BANK ACCOUNT: Payment may be made by bank transfer in the name of BROOKLYN BOY S.L. to the following account number: La Caixa 2100 2219 5702 0054 4522, indicating in the concept: code of the route, name and surnames, and travel modality (Pj: BdQ, Enrique Peláez, GUIDED).

5. Prices

Prices are based on transport rates, accommodation, restoration, bicycle rental, travel insurance, currency exchange rates, taxes and fees effective on January 2nd of the current year. Any variation in the price of the aforementioned elements may result in the revision of the final price. These modifications will be notified to the client, who, in the event that the modification made exceeds fifteen percent (15%) of the price of the bike travel, will be able to desist from it without any penalty, or accept the modification of the contract. In no case will prices be revised upwards in the twenty (20) days prior to the departure date, for those registrations already made and confirmed.

5.1. Special offers

When contracting a bike travel as a result of special offers, last minute or equivalent, promotions or whatever price other than that expressed in the program / web, services included in the price are only those that are specified in detail in the offer, even when the special offer refers to any of the programs described in this website, provided that it is made for the exclusive purposes of general information of the destination.

6. Services included and not included

Given the current popularity of self-guided bicycle routes, BICICLETOS VIAJES offers two types of travel: guided and self-guided routes. All the routes offered are indicated with the cities of origin and end of each route. Services included are those specified in each trip and in the additional information provided. In case of modification of the circuit before departure, services included and not included will be attended according to the information pack.

6.1. SELF-GUIDED ROUTE mode includes:

An information pack that consists of an information dossier with a detailed description of the route, GPS track(s), possible fountains and singular trees along the itinerary, and a series of recommendations and contacts on outstanding places of interest, scenic stops, cultural offer, gear list, accommodation offer, nutrition advice, restaurants, taxi services, as well as possible mechanical workshops in the area, as well as a telephone line in case of problems or emergency situations.

In addition, in the modality of self-guided routes we offer the following services:

Accommodation, in the conditions and with the food regime offered by each supplier.
Individual accident insurance, on the dates and conditions specified for each client. See chapter 12.
Bicycle rental, its accessories and services of transfer and collection, in the conditions specified for each client. Subject to availability.
Luggage transfer throughout the stages. Subject to availability.
All other services and accessories that are specified in the contracted program or that are expressly stated in the travel contract.

6.2. GUIDED ROUTE mode includes:

In addition to the information pack:

An individual accident insurance for group activities. Assistance and civil liability insurance is mandatory to travel in a group by bicycle. See chapter 12. More information: Insurance for guided tours.
Accommodation, in the conditions and with the food regime offered by each supplier. Rates or taxes of hotel establishments and indirect taxes when applicable and detailed as included.
Professional Guide technical assistance during the trip, once the minimum number of travelers specified is met.

6.3. Travel does not include:

Bicycle, personal material, visas, airport taxes, and / or entrance and exit taxes, vaccination certificates, entrances of cameras and videos, personal expenses, tips, extras, all kinds of alcoholic beverages and mineral waters, food, diet special services, clothes washing and ironing, optional hotel services, and, in general, any other service, mentioned here or not, that is not expressly included in section 6.1 or is not specifically detailed in the program, in the contract or in the documentation that is delivered to the client.

6.4. Excursions, visits or optional services

In the case of excursions, visits or optional services not contracted at source, it should be noted that they are not part of the combined travel contract. Its publication on the web is purely informative and the price is not expressed, or published will be considered as "estimated". On the other hand, these services will be offered to the client with their specific conditions and definitive price independently, not guaranteeing the possible realization of them until the moment of contracting.

7. Documentation

All the people registered in a bike travel are responsible for having in order the necessary documentation for the country that is visited (D.N.I., passport, visas), as well as the sanitary requirements necessary. BICICLETOS VIAJES acts as an informant, but it is the responsibility of the client to confirm any information with the competent authorities. Obtaining visas, passports, vaccination certificates, etc. will be for their account. In case of being rejected the granting of visas by any Authority, for whatsoever reasons, or being denied entry to the country due to lack of the requirements that are demanded, or by defect in the required documentation, it will be for the client account any expenses that arise, applying in these circumstances the conditions and rules established for the cases of voluntary withdrawal of services (see chapter 9 of these General Conditions).

8. Baggage

BICICLETOS VIAJES is not responsible for incidents related to luggage and personal effects of their customers. Its transportation will be at the client's risk. It is recommended that clients are present in all handling of loading and unloading their luggage. Regarding air, rail, maritime or fluvial baggage transport, the conditions of the carriers will apply, the ticket being the binding document between the companies and the passenger. In the event of suffering any damage or loss, client must present the claim to the transport company in the act. In this sense, BICICLETOS VIAJES will provide the opportune assistance.

9. Withdrawal, assignments and cancellations

Clients must reconfirm with BICICLETOS VIAJES, within 48 hours prior to the scheduled departure: the meeting point, date, and time. If this reconfirmation is not made, BICICLETOS VIAJES declines all responsibility in case of alterations on the information given previously.

At all times the client can desist from the services requested or contracted, having the right of refund of the amounts paid, whether it is the total price or the reservation fee, but in any case client must compensate to BICICLETOS VIAJES for the management expenses and possible expenses of cancellation of the services already contracted to the different providers.

In case of no presentation at the time of departure, without prior documented cancellation, or late submission, it would mean the total loss of the tourist package amount (unless otherwise agreed between the parties).

In addition, BICICLETOS VIAJES is entitled to a penalty consisting of 5% of the total amount of the bike travel if the cancellation occurs between fifteen (15) and ten (10) calendar days prior to the starting date of the bike travel, at 15% if it occurs between ten (10) and three (3) calendar days, in 25% if it is abandoned in the previous 48 hours and in 100% if it is not presented at the scheduled time of departure.

If the cancellation causes damage to the other participants, due to not being able to reach the minimum number of passengers planned for the departure of the bike travel, or for the application of special fares, BICICLETOS VIAJES will also retain the necessary amount to allow the fares mentioned may continue to apply.

In the cases in which the realization of a bike travel is subject to have a minimum number of participants, and so it is specified, BICICLETOS VIAJES may cancel the bike travel in case that this minimum number of participants is not reached, notifying it with a minimum of ten (10) calendar days before the scheduled departure date.

Likewise, BICICLETOS VIAJES may also cancel a bike travel due to force majeure, understanding as such those circumstances unaware to the party invoking them, abnormal and unforeseeable, whose consequences could not have been avoided, despite having acted with due diligence. In this case, client will be entitled to reimbursement of the amounts paid, except for management expenses.

In the cases that BICICLETOS VIAJES determines, and so expressly specifies, the completion of a bike travel offer to have a minimum number of participants and that number is not reached, the cancellation of the bike travel occurs, client will be entitled exclusively to the refund of the total of the price or reservation fee, without being able to claim any amount as compensation, as long as BICICLETOS VIAJES has notified it by writing with a minimum of ten (10) calendar days before the scheduled departure date.

Previous penalties and indemnities will not apply when client transfers his/her reservation to a third person, provided that the companies that provide the services do not prevent it and the modification is made more than five (5) calendar days before the departure date. In this case, BICICLETOS VIAJES must be compensated with the expenses incurred to make the substitution.

Force majeure causes will be considered for these purposes:

1) In relation to circumstances external to the client:

- As a precaution against a foreseeable risk originated by a circumstance that occurred after the contract of the bike travel or of your order. This claim will be considered valid when there is accredited information from the Ministry of Foreign Affairs, via Internet, in which it is recommended not to travel to a certain destination, or not to travel if it is not absolutely necessary or even not to travel if the reasons are purely touristic.

- In cases where there is an objective impossibility of making the bike travel, by official prohibition or by some other circumstance, such as closing the airspace, which is impossible to save, there will be no "withdrawal" from the client. In this case, all the amounts paid by the client will be reimbursed, except in the case that another bike travel of superior or equivalent quality is offered and accepted.

2) In relation to the client's circumstances:

- Due to death or extreme seriousness of a family member in the first degree or his own, or similar causes that impede the bike travel.

10. Alterations

When the organizer is obliged to significantly modify the essential elements of the bike travel contract before the departure date, it will notify it to the client by e-mail as soon as possible so that he/she can choose between rescinding the reservation or the contract, with the right to full refund of the amounts paid, or accept the consequences of the modification of the initial bike travel. Client must communicate the decision adopted to BICICLETOS VIAJES within three (3) days after being notified of the modification. In the event that the client does not communicate by e-mail his/her decision within three (3) business days following the notification, it will be understood that he/she opts for the cancellation of the reservation or the contract without any penalty.

In case the client chooses to terminate the contract, he/she will be entitled to reimbursement of all amounts paid, or to the completion of another bike travel of equivalent or superior quality, provided that BICICLETOS VIAJES can propose it. In case the bike travel offered was of inferior quality, BICICLETOS VIAJES must reimburse the client the price difference, when applicable and depending on the amounts already paid, according to the contract.

If before the bike travel or during the same, BICICLETOS VIAJES is unable to provide any of the services under the agreed conditions, BICICLETOS VIAJES will adopt the appropriate solutions for the continuation of the bike travel, without price supplement for the client, and in this case, it will reimburse the amount of the difference between the benefits provided and those provided. Changes made due to weather conditions, unforeseen impositions of the suppliers or due to limited local infrastructure, are accepted as long as they do not involve the non-fulfillment of any of the services included in the contracted bike travel. In this case, both BICICLETOS VIAJES and the suppliers will be responsible for payment to the client of the compensation that, if applicable, corresponds to breach of contract, which will be 5% of the total price of the contracted bike travel, if the aforementioned breach occurs between the two (2) months and fifteen (15) days immediately prior to the departure date; 10% if it occurs between fifteen (15) days and three (3) days before, and 25% in case that the aforementioned breach occurs from the previous 48 hours.

There will be no obligation to compensate in the following cases:

When the cancellation is due to the fact that the number of people registered for the bike travel is lower than the required and thus communicated it by writing to the client before the departure date.
When the cancellation is due to reasons of force majeure, meaning those circumstances beyond the invoking, abnormal and unpredictable, whose consequences could not have been avoided, despite have acted with due diligence.

In the event that, after the departure of the bike travel, BICICLETOS VIAJES does not provide or verify that it can not provide an important part of the services provided in the contract, it will adopt the appropriate solutions for the continuation of the bike travel, without any price supplement for the client, and, where appropriate, pay the latter the amount of the difference between the expected services and those provided. If the client continues the bike travel with the solutions provided by BICICLETOS VIAJES, he/she will be considered to accept these proposals tacitly. If the solutions are not accepted by the client for a reasonable decision, BICICLETOS VIAJES must provide the latter, without any price supplement, with a means of transport equivalent to that used in the bike travel to return to the place of departure or to any other that both have agreed, notwithstanding the compensation that may be applicable.

No refund will be made for services not used voluntarily by the client, whatever the cause of the non-use.

If transfers from the hotel, airport or similar, included in the offer, are not met, mainly for reasons beyond the control of the carrier and not attributable to BICICLETOS VIAJES, the latter will reimburse the amount of the alternative transportation used by the client on the bike travel, upon presentation of the corresponding receipt or invoice.

11. Responsibilities

BICICLETOS VIAJES explicitly states that it acts as an intermediary between the clients and the entities or persons that provide the services indicated in the itinerary. BICICLETOS VIAJES will respond to the client for their respective service of travel management. In no case BICICLETOS VIAJES are responsible for possible breaches in the services contracted to the different providers. Client must first contact the corresponding service provider, then inform as soon as possible to BICICLETOS VIAJES, which will work diligently to find appropriate solutions in the resolution of the possible conflict. In this sense, client is obliged to report any breach in the execution of the contract.

In the event that the solutions arbitrated by BICICLETOS VIAJES are not satisfactory for the client, he/she will have a period of one (1) month to complain to the supplier, who will have forty-five (45) calendar days to respond to the claim raised by the client, term that will begin to be counted from the day following the presentation of the claim to the provider.

Notwithstanding the provisions of the preceding section, the period of limitations for actions derived from the rights recognized in Legislative Decree 1/2007 of November 16th, which approves the Consolidated text of the General Law for the Defense of Consumers and Users, it will be two (2) years.

BICICLETOS VIAJES will be liable for the damages suffered by the client as a consequence of the non-execution or deficient performance of the contract. Responsibility shall cease when any of the following circumstances occurs:

That the defects observed in the execution of the contract are attributable to the client.
That said defects are attributable to a third party that is not involved in the provision of the services envisaged in the contract and that are unforeseeable or insurmountable.
That the aforementioned defects are due to reasons of force majeure, understanding as such those circumstances unrelated to the party invoking them, abnormal and unforeseeable whose consequences could not have been avoided, despite having acted with due diligence.

However, in the cases of exclusion of responsibility for any circumstances provided in numbers 2, and 3, both the provider and BICICLETOS VIAJES will be required to provide the necessary assistance to the client who is in difficulties.

When the bike travel is made in coaches or cars hired by the agency directly or indirectly and an accident occurs, whatever the country where it occurs, client is expressly subject to the legislation on accidents in the country in which the vehicle is enrolled. In this case, client will have to present the possible claims against the carrier entity in the respective country, in order to safeguard the insurance indemnity of the latter.

In no case, all those services not included in the travel contract (such as transport tickets from the place of origin of the passenger to the place of departure of the bike travel, or vice versa, hotel reservations in days before or after the bike travel, etc.) will be the responsibility of BICICLETOS VIAJES, there being no obligation to compensate for those possible expenses of independent services in case the bike travel is canceled due to the causes foreseen in chapter 9 of these General Conditions.

BICICLETOS VIAJES is not responsible for the cost of accommodation, transportation, maintenance, repatriation or others that arise as a result of delays in the departure of flights or other means of transport for whatever the cause. BICICLETOS VIAJES will not be responsible during a bike travel for changes in the program as a result of schedule adjustments or delays by transport companies.

BICICLETOS VIAJES understands that the physical condition of the clients meets the necessary conditions to carry out the bike travel, in which they freely participate. Client is informed that he/she hires an activity of medium risk, assuming any incidence that could arise in its development. Consequently, client excuses BICICLETOS VIAJES any responsibility regarding derivations that this physical effort or sporting exercise may entail. In any case BICICLETOS VIAJES does not assume any responsibility and does not accept people with physical deficiencies or illnesses to whom doctors and physicians would have advised against this type of activity. BICICLETOS VIAJES reserves the right to admit or expel those persons who, in their objective criteria, do not meet the necessary requirements for the completion of the bike travel or whose performance hinders the smooth running of the bike travel and harmony in the coexistence of the group. On the other hand, client, when registering and contracting our services, accepts the characteristics of the route and undertakes at all times to follow the instructions of the BICICLETOS VIAJES representative.

If the bike travel is made with a bicycle owned by the client, BICICLETOS VIAJES is not responsible for any damage, breakdown, theft or loss that may arise during the bike travel.

BICICLETOS VIAJES is not responsible for damages, losses, losses, claims or expenses derived from the use of the Website. It will only be responsible for eliminating, as soon as possible, contents that may generate such damages, provided that this is notified. In particular, it will not be responsible for the damages that could be derived, among others, from:

(i) interferences, interruptions, failures, omissions, telephone breakdowns, delays, blockages or disconnections in the operation of the electronic system, caused by deficiencies, overloads and errors in telecommunication lines and networks, or by any other cause beyond the control of BICICLETOS VIAJES.

(ii) illegitimate intrusions through the use of malicious programs of any kind and through any means of communication, such as computer viruses or any other.

(iii) improper or inappropriate abuse of the Website.

(iv) security or navigation errors caused by a malfunction of the browser or by the use of non-updated versions thereof. BICICLETOS VIAJES reserves the right to withdraw, totally or partially, any content or information present on the Website.

BICICLETOS VIAJES refuses any responsibility for damages of any nature that could be due to the misuse of the services freely available and used by the users of the Website. Likewise, BICICLETOS VIAJES is exempt from any responsibility for the content and information that may be received as a result of the data collection forms, being the same only for the provision of query and doubt services.

12. Insurance

Hiring of any bike travel or service also implies the obligation to hire an individual accident insurance. Coverages and conditions are available to the client at the time of registration and can be viewed at any time on the Website, in the section of frequently asked questions. As it is considered a compulsory element of the bike travel, if the client wishes to reject the inclusion of this, for any reason, he/she must do so by choosing the corresponding option in the registration forms of the Website, exempting BICICLETOS VIAJES from any responsibility. In this sense, client commits to present a copy of his/her insurance policy at the moment of satisfying the final amount. BICICLETOS VIAJES will provide all the information required to comply with this requirement, in compliance with the General Law for the Defense of Consumers and Users. BICICLETOS VIAJES is separate from the resolutions that the insurance company determines about the incidents declared by the client and has no responsibility for such responses. Claim processing to insurance companies will correspond exclusively to the client, and BICICLETOS VIAJES has no responsabilities of this process.

13. Social Economy Market

BICICLETOS VIAJES is a services provider of the Social Economy Market of Madrid (MESM, for Spanish). MESM defines itself as "A network of production, distribution and consumption of goods and services that works with ethical, democratic, ecological and solidary criteria established by companies and organizations of the social and solidarity economy, altogether with collective and individual consumers, whose goal is to cover a significant part of the needs of its participants within the network and disconnect the solidarity economy from the capitalist economy, as much as possible." BICICLETOS VIAJES participates as a bicycle travel services provider.

14. Validity

These general terms and conditions have been drafted at June 11th 2014, revised on September 11th 2018, and have an indefinite applicability.
